Tribunal Admits Tinubu’s Chicago University Education Record, US Visa In Evidence

Mohammed Shosanya

The Presidential Election Petition Court sitting in Abuja has admitted the Chicago State University educational credentials of President Bola Tinubu in evidence.

The documents are part of exhibits being relied upon by Tinubu to defend allegations of electoral fraud, non qualification and certificate forgery made against him by the Peoples Democratic Party and its presidential candidate, Abubakar Atiku, ahead the February 25, presidential election.

Tinubu, who formally opened his defense in a petition filed against his election by Atiku,
presented the credentials and other documents to the PEPC on Tuesday, through his lead counsel, Chief Wole Olanipekun (SAN).

The educational credentials tendered in evidence by Tinubu was to prove his attendance and graduation at the Chicago State University included the admission letter.

Also tendered before the PEPC, was his US visa documents which indicated that he severally visited the United States of America unhindered between 2011 and 2021.

Besides,Tinubu tendered all documents of the Nigeria Immigration Service (NIS) which cleared him for the US trips.

The Uinted State of America’s Embassy letter of April 4, 2003, which was a response to a letter of the Nigerian Police dated February 3, 2003, which claimed that the Embassy had no criminal records of Tinubu in the USA, was further submitted to the Tribunal

The court further admitted an originating summon of a suit filed at the Supreme Court by the Attorneys General of Adamawa, Akwa Ibom, Bayelsa, Delta, Edo and Sokoto States challenging the educational background of Tinubu to stand for the 2023 presidential election.

The petitioners opposed admissibility of all the documents, but Chairman of the PEPC, Justice Haruna Tsammani, admitted them in evidence.

The Independent National Electoral Commission (1st respondent) and the All Progressives Congress (3rd respondent) in the petition, did not object to admission of all the documents.

The court fixed further hearing in the petition for July 5.

Tinubu will on Wednesday, July 5, open his defence in the petition filed against his election victory by the Labour Party and its presidential candidate, Peter Obi.

His decision to begin defense followed INEC’S dramatic decision on Tuesday to terminate its own defence in Obi’s petition after calling one witness and tendering four documents.

INEC had during the pre hearing session informed the PEPC that it would need three days to call three witnesses.

But on Tuesday, INEC’s lead counsel, Mr Abubakar Mahmoud (SAN) suddenly announced the closure of INEC’s defense.

Tinubu’s lead counsel, Chief Wole Olanipekun (SAN) informed the PEPC that he is ready to begin Tinubu’s defence on July 5 with his witnesses and documents.

At the Tuesday’s hearing, a witness called by INEC, Dr Lawrence Bayode admitted that the BVAS machines used by the electoral body suffered glitches during the presidential election but maintained that the glitches did not in any way affect conduct of the election, collation of results and declaration of final results.

Electoral Breaches: INEC Commences Prosecution Of Adamawa REC,Others

The Independent National Electoral Commission (INEC) declared on Tuesday that it set to commence the prosecution of Adamawa State Resident Electoral Commissioner and 215 others whose case files have been submitted by police.

Its chairman,Prof Mahmood Yakubu disclosed this while addressing resident electoral commissioners at the INEC headquarters,on Tuesday in Abuja.

He disclosed that the commission is in receipt of the case files of the Adamawa Resident Electoral Commissioner and 215 others after completion of police investigation, adding that the commission is collaborating with the Nigerian Bar Association (NBA) towards their prosecution.

He said similar collaboration is ongoing with the Economic and Financial Crimes Commission for the prosecution of those involved in vote buying.

He disclosed that about 427 lawyers have volunteered under the auspices of the NBA to prosecute the suspects pro bono, even as he insisted that the 2023 general elections was a huge success despite the divergent opinions expressed.

He added:”Our record shows that these elections have produced the most diverse outcomes ever recorded since 1999. Today, five political parties produced State Governors, seven parties won Senatorial seats, eight are represented in the House of Representatives and nine in State Houses of Assembly.

“Clearly, the 10th National Assembly is certainly the most diverse in party representation since 1999. In some States around the country, different political parties controlled the legislative and executive arms of Government. What is clear from these records also is that the days of single party dominance of our national politics are probably gone. Furthermore, many prominent candidates lost in the constituencies they contested, and political parties lost in some of their presumed strongholds.

” Accreditation of voters using the Bimodal Voter Accreditation System (BVAS) has generally been scored very high by voters. Our records show that the success rate for BVAS accreditation stands at 98% compared to the Smart Card Reader’s 29.2% during the 2019 general election” he stressed.

“We are working with the Nigerian Bar Association (NBA) to prosecute the alleged offenders. Already, the NBA has submitted a list of 427 lawyers across the country who have volunteered to render pro bono services to the Commission.

“They are not charging legal fees but by mutual agreement the Commission will provide a token amount to cover for filing fees/expenses. We are most grateful to NBA and its President, Yakubu Maikyau SAN, for this historic collaboration.

” Similarly, we are working with the Economic and Financial Crimes Commission (EFCC) and the Independent Corrupt Practices Commission (ICPC) on the prosecution of cases relating to vote buying and associated violations”.

The INEC boss said the meeting of the RECs was the first of “several internal debriefing meetings ” thay will culminate in engagements with stakeholders.

” I implore the Resident Electoral Commissioners, as senior officials of the Commission, to lead the discussion on all aspects of the election from preparations, conduct and aftermath frankly and constructively. Among other issues, I expect you to cover such specific areas as:

“Operational processes for the Continuous Voter Registration (CVR) and general elections, including planning, organisation, coordination and evaluation of activities, focusing particularly on such specific issues as the issuance of voters’ cards, logistics, delivery of materials, deployment of personnel, etc.

“Legal framework for the conduct of elections with a view to addressing any key legal challenges that may have arisen prior to the 2023 General Election which were not envisaged before the election;

“Technologies deployed in the electoral process, including the INEC Voter Enrolment Device (IVED); INEC Result Viewing Portal (IReV); Bimodal Voter Accreditation System (BVAS); party nomination portal; observer, media and polling/collation agents’ accreditation portals etc., focusing particularly on their performance;

“Effectiveness of overall administrative procedures and channels within the Commission in the coordination and execution of pre-election, election and post-election activities;

“Political party registration, party primaries and nomination of candidates for the 2023 General Election, as well as monitoring of the process.Process of recruitment, training, deployment and performance of all categories of ad-hoc staff during CVR and the General Election

“Strengthening the Commission’s cooperation and relations with other bodies such as MDAs, NGOs etc. and any other issues in the electoral process that are likely to impact the work of the Commission in future. “amongst other recommendations.

ASCSN Backs New Retirement Age For Civil Servants

Mohammed Shosanya

The Association of Senior Civil Servants of Nigeria,ASCSN, has reiterated its call for upward review of the retirement age for employees in the core civil dervice which consists of line Ministries and Extra-Ministerial Departments/Agencies.

The union’s Secretary-General, Comrade Joshua Apebo, in a statement on Tuesday, recalled that since 2015, it has been canvassing for upward review of the retirement age for employees in the core civil service.

He said:“Indeed, in 2015, the Association presented a memorandum to the Joint National Public Service Negotiating Council (JNPSNC), the organ that is responsible for negotiation of terms and conditions of service of workers in the Public Service, and demanded for the increase in retirement age in the Core Civil Service from 60 years of age or 35 years of service whichever is earlier to 65 years of age or 40 years of service whichever comes first.

“ Our argument then which is still valid today is that due to improvement in health care delivery, people are now stronger, healthier and more articulate between the ages of 40 years and 70 years,’’ he stated.

He also emphasized then that most of the organizations attached to the United Nations and a good number of countries have increased retirement age to 65 years.

According to him,International Organisations such as the International Labour Organisation (ILO), the World Health Organisation (WHO), European Patent Office (EPO), Organisation of Economic Co-operation and Development (OECD), Bank for International Settlements, etc, have also increased retirement age to 65 years while retirement age in NATO is 67 years.

He said that retirement age in Germany, Macedonia, Kenya, etc, is 65 years while over 95% of countries of the world have retirement age of well above 60 years.

“Indeed, in South Africa, there is no single compulsory retirement age, except that there is a minimum retirement age of 65 years but a public servant can continue to work subject to suitability and health requirement,” he added.

He stated further that since 2015, the Association has continued its advocacy through memoranda to the Joint National Public Service Negotiating Council (JNPSNC) and at meetings with various government organs that retirement age in the Civil Service should be increased from 60 years or 35 years of service whichever is earlier to 65 years or 40 years of service whichever comes first.

“In fact, when the Federal Government approved 65 years of age or 40 years of service for teachers, the Association intensified its campaign that Education Officers in the Federal Ministry of Education including those in Federal Government Colleges should be integrated in the new retirement age and the government approved the demand.

“Since Judicial Officers, Universities Lectures, Teachers, etc, are now enjoying the new retirement age regime, it is only fair that the new retirement age of 65 years or 40 years of service whichever comes first should also apply to core civil servants,” he stressed.

He implored the Trade Union movement to join the train and ensure that there is uniformity in retirement age in the Public Service including the core civil service.

Sit-At-Home Order: Enugu Government Threatens To Shut Schools, Markets

Mohammed Shosanya

The Enugu state government has threatened to shut down institutions and markets that observe the one week sit- at -home order rumoured to have been declared by Simon Ekpa’s faction of the IPOB group.

Professor Chidiebere Onyia
Secretary to the state government issued the threat in a statement on Tuesday

He said: “Our attention has been drawn to reports on social media this Tuesday morning that proprietors of private schools in the state are sending messages to their pupils and students to the effect that they should not come to school from today on account of the illegal one week sit-at-home order allegedly declared by faceless non-state actors in the state.

“The Enugu state government is alarmed and dismayed by this development and hereby warns that any school that fails to open and function normally from today will have its license revoked immediately.

“The Enugu state government also extends the same warning to market unions and shop owners in the state. All markets and shops in the various markets must be open to customers from today or be shut down indefinitely”

The government reiterated its proscription of any form of illegal sit-at-home in all parts of the state, as it is evil and antithetical to all values we hold dear as a people, such as the Igbo spirit of industry, hardwork, creativity and productivity.

He urged the general public to go about their normal daily activities as adequate security measures have been put in place to protect lives and property.

He said “Government will no longer sit by and watch faceless groups and misguided individuals issue illegal orders, dictating to us how to lead our lives, when to go to work or market and when our children go to school, while they ply their trade and their children go to school. This is no longer acceptable and must be confronted and defeated with every power and resources at our disposal”

JAMB Stops Mmesoma Ejikeme From Sitting UTME,Withdraws 2023 Result

Mohammed Shosanya

The Joint Admissions and Matriculation Board (JAMB) has barred Miss Joy Mmesoma Ejikeme from sitting the Unified Tertiary Matriculation Examination (UTME) for three years.

It also withdrew her said result pending further investigation into the matter.

Dr Fabian Benjamin, Acting Director Public Affairs Department of JAMB,who disclosed on Tuesday morning, said the Board is sticking to its earlier position that the UTME result being paraded by Ejikeme Joy Mmesoma is patently fake.

“In the meantime, the management of the Board, after considering the weighty infraction committed by Ms. Ejikeme Joy Mmesoma, and in line with it’s established procedures, has withdrawn her 2023 UTME result and also barred her from sitting the Board’s examination for the next three years,” the statement noted.

He reassured Nigerians that its system was neither tampered with nor compromised as the candidate simply falsified a copy of a result slip of a candidate named “Asimiyu Mariam Omobolanle”, who sat the UTME in 2021 and scored 138.

He added:It is also instructive to note that the candidate, in her statement, has inadvertently revealed the rightful owner of the result she is parading when she pointed out that the QR code on the result slip showed the actual owner of the said result before she peddled a lie in an attempt to obfuscate the truth.

“To witness the unassailable position of the Board regarding this obvious falsehood, the general public is, therefore, urged to endeavour to scan the QR code on the result slip to see its actual owner before it was mutilated.

“It is to be noted that the QR code encapsulates the UTME result of each candidate, hence, what is on the result sheet is nothing other than the interpretation of the information on this QR code.

“Furthermore, the public is also to note that the Board stopped issuing Notification of Result slips after the 2021 UTME for the simple reason that candidates were falsifying them. Consequently, the Board has been issuing actual UTME RESULT Slips (not notification of results ) since 2022 complete with the photograph of each candidate.

“Similarly, the public is also invited to ponder on the fact that out of all the candidates that sat the 2023 UTME, only Ms. Ejikeme Mmesoma parades the obsolete ‘Notification of Result.’

“The Board remains unperturbed by this unfortunate development as this is not the first time such fraudulent claims have been made. As such, Nigerians are urged to recall numerous occasions where the Board was sued for billions of naira only for the lawyers to later apologize profusely for their clients’ misadventure.

“Prominent among these is the case of a candidate, John Chinedu Ifesinachi, who, in 2021, wrote a letter to the Board , threatening to sue for N2b damages, only for him and his counsel to tender unreserved apology when the candidate eventually confessed his crime in the face of incontrovertible facts in an open investigation observed by several national public institutions including the Public Complaints Commission, National Human Rights Commission, Federal Competition and Consumer Protection Council, Servicom and media houses.

“This case has, therefore, being rightly handed over to relevant security agencies for thorough investigation to unravel the masterminds of yet another unfortunate scam.

“The Board is not averse to public scrutiny and is ready for open public session involving the agencies listed above as well as relevant security agencies where the candidate , parent’s guardian and her legal team will be present.

“Another frightening dimension to the unfolding drama is the unwholesome interest of some nefarious elements, who to all intents and purposes, are determined to goad the candidate on this unproductive path as any casual observer would observe with the obviously stage-managed video aired by Ms. Ejikeme. The Board urges these confusionists to have a rethink as their evil machinations would soon come to light.

“Again, the Board restates its readiness for genuine scrutiny as this case would not be the first time and might not even be the last of such shenanigans. At the end of the day, the truth would manifest and the Board vindicated.

“In the meantime, the management of the Board urges member of the public to examine critically the issue at hand and avoid fake news trafficking”

Tinubu On The Familiar Turf

By Ebun-Olu Adegboruwa, SAN

This is the way it has always been when a new leader assumes the mantle. In 2015, all that many Nigerians wanted was anything but Goodluck Jonathan, the former President.

President Muhammadu Buhari was presented as a preferable alternative and the Messiah that Nigeria needed at the time. Strangely, the arrowhead of that campaign would later take over from Buhari in a twist of fate.

Immediately Buhari was sworn in, the goons went to town and they regaled us with catalogues of woes that the political party they took over from had committed, as if that was not the very reason they were elected into office. Even till his last days in office, Buhari’s handlers were still talking of 16 wasted years of PDP.

In those days of the commencement of his tenure, Buhari was said to be the best thing to have happened to Nigeria after independence. We were told that his body language alone had restored stable electricity and wiped off corruption from Nigeria. But we became wiser with time.

As they say, when people have been subjected to years of neglect and poor leadership, any little effort from a new leader would be misinterpreted as revolutionary. But we are wiser now, as a people. Or so I believe.

On May 29, 2023, His Excellency, Senator Bola Ahmed Tinubu was sworn in as the President of the Federal Republic of Nigeria, ostensibly to fulfil his lifetime ambition. He immediately committed himself to the abolition of the fuel subsidy regime and also promised the unification of the exchange rate regime. He subsequently dissolved the security chiefs and also sacked the boards of all federal government agencies and parastatals.

This is the usual stock in trade, at times to raise the consciousness of the people and at other times to buy support and loyalty. These positions have to be filled one way or the other. The judiciary is key to the success of any government and so it was not surprising that he quickly assented to the Bill for the unification of the retirement age of all judges of the superior courts across board.

The appointments made so far are clearly predictable; the Chief of Staff, the Inspector-General of Police, the Chief of Army Staff, the Central Bank Governor, the Comptroller-General of Customs, etc, all from the same region. When taken side by side the Chief Justice of Nigeria, the Chairman of ICPC and the Comptroller-General of Immigrations, we can well define the real meaning of nepotism.

Take it or leave it, the majority ethnic groups would take no prisoners; so it was under Buhari, so it is now under Tinubu and so it will be, even under His Excellency, Peter Obi. There is nothing new. People should not delude or deceive themselves to think that any leader has come to their rescue.

The main three-fold planks of the Buhari administration were security, anti-corruption and the economy. The seemingly stable electricity supply that was contrived as a product of his body language at the commencement of his tenure later turned out to be the worst in the history of Nigeria with 99 national grid collapses, the anti-corruption war so consumed the government that even the symbol of that struggle (EFCC Chairman) was himself swallowed by it.

In a way that jolted Nigerians, some of those who were convicted by the court of corrupt practices were granted state pardon by Buhari and some others that had corruption cases or charges pending against them were smart to join the political party in power to have the cases dropped or abandoned. It is not different from what we are currently witnessing, wherein the EFCC Chairman has been accused of corruption and abuse of power without a charge filed against him in court.

It is the style of new administrations in order to be seen as doing something and to have enough time to settle down, before baring their fangs. President Buhari actually canvassed for judicial independence by signing the law granting financial autonomy to the judiciary but in the same vein, no other administration has victimized, intimidated and humiliated the judiciary as much as the Buhari administration, when we remember how security agencies stormed the houses of judges and how the head of the judiciary was booted out of office through unconventional ex-parte orders.

The euphoria of fuel subsidy removal by President Tinubu, the commendations from the foreign nations about the exchange rate unification and the devaluation of the Naira would seem to have driven the President into some kind of inaction, whereby one month after his inauguration, there is no cabinet in place, just as it happened under the Buhari regime.

Initially when he started, President Buhari had promised to take the battle to the insurgents and the bandits but in the end, we were later to be informed that even in Aso Villa in Abuja from where he operated, the President was in mortal dread of #EndSARS protesters, whom he thought were sponsored to overthrow his government. In the end, Nigeria suffered the most heinous pogrom ever, with thousands of lives lost to herdsmen, kidnappers and bandits, in which human lives were wasted like common chickens.

In the same place where President Tinubu scooped out the Electricity Bill are also the Hononourable Justice Muhammadu Lawal Uwais Report on Electoral Reforms, the Orosanye Report on the merger of government agencies to cut corruption and wastages and indeed the 2014 National Conference Report for the integration of Nigeria. In that same Aso Villa, there are reports of the Judicial Panels on Police Brutality from across the States and most importantly, there is also the Governor El-Rufai Committee Report on Restructuring, all gathering dust.

President Tinubu is not new in the saddle. For the period when he was in the opposition, he championed true federalism and restructuring, he fought for the rule of law, devolution of powers and state police. Several Bills passed by the 8thand 9th National Assemblies concerning devolution of powers which the Buhari administration ignored are staring at President Tinubu in Aso Villa everyday. Are we now to preach restructuring to the President, or are we to embark upon a fresh campaign on the need to amend the 1999 Constitution or to write a fresh one?

On national television recently, a former governor exposed the gargantuan corruption within the oil and gas sector, especially as it relates to fuel subsidy. Aso Villa has been mum ever since, carrying on business as usual. There is a pending judgment of the National Industrial Court of Nigeria directing the increment of the salary of judicial officers, there is judicial authority for the release of Nnamdi Kanu from custody and another judgment for the payment of damages to Sunday Igboho.

Policy decisions which do not address the real issues plaguing our land amount to nothing but mere tokenism and in like manner, occasional pronouncements made to curry favour and to buy loyalty all suggest opportunism.

The President should address fundamental changes, which should begin with the leadership. When Nigerians see genuine repentance from our leaders, they will not require long sermons to embrace true change. With the drama of the convoy of the President during his last visit to Lagos, no sincere message of change can be preached to our people.

It is not too early for the President to unveil his cabinet, to cut the budget of the executive and remove the subsidies that promote isolated luxuries for leaders in the midst of abject poverty, want, and sufferings for the people. If it is not the case that the President is walking on the familiar turf, he should walk the talk, rediscover the Tinubu that was part of NADECO, obey all extant decisions of the Courts and give the people true leadership.

All the sweet things said about the President, that he is his own man, that he would dare the owners of Nigeria, that he would rule in the interest of the masses and that he would turn around the economy of Nigeria, should begin to manifest even from the first month of his leadership.

If we have to organize press conferences to remind the President that Nigeria is in dire need of restructuring, if we have to embark upon any form of protest to get the President to support the agitation for resource control, gender parity, state police, devolution of powers, local government autonomy and true federalism, then it would mean that we still have a long way to go.
