The Brouhaha About The Trial Of Minors

Was it right to try minors for waving the national flags of other countries? Was this an act that constitutes a criminal offence? Was there mens rea (intention) and actus reus (physical consummation of the intention)?

These are some of the questions generated by the recent arraignment of minors that rightly generated national ruckus. Let us briefly interrogate these questions.

Treason is defined in section 410 of the Penal Code as “levying war against the State” with the intention of “over-awing the (President)”. It is punishable with death.

Treasonable felony (or “crimes”), on the other hand (as defined in section 412 of the Penal Code), manifests in, amongst others, an overt act done with the intention of either compelling the government to effect a change of policy, to intimidate, or to overawe the Legislature or to instigate a foreigner to invade Nigeria. It is punishable with life imprisonment.

It must be noted that while the Penal Code applies in the Northern part of Nigeria, the Criminal Code (and it’s variants) applies in the South. Provisions similar to those under the Penal Code also exist in the South.

It appears to me too far-fetched to charge a person with treason simply for merely waving a foreign flag in Nigeria, without more. There must be something overt, capable of igniting the intention, otherwise it will amount to criminalising a person’s  right to freedom of speech and expression which is guaranteed under the 1999 Constitution.

Instigating our military (or that of another country) to overthrow the government would clearly constitute such an act; but nothing of the sort was shown in the case of the minors.

It must be pointed out that no law prohibits the prosecution of a person for violating any law – including treason or treasonable felony – unless he or she is less than 7 years old or if, between the ages of 7 and 12, he lacks the requisite maturity and capacity to understand the nature and consequences of his or her acts. See Section 50 of the Penal Code.

Subject to such express exceptions provided, such a person of less than 18 years of age should only be arraigned before a Family Court established under the Child Rights Act or Law (defined as a High Court judge or Magistrate sitting with 2 assessors); but certainly not while they are exercising their regular jurisdiction.

All persons except court staff, the accused, their counsel and family members are excluded from such proceedings under sections 149, 150, 151, 152 and 162 of the Child Rights Act which is in force in Abuja. Similar provisions exist in the Child Rights Laws of various States that have domesticated the Act.

It therefore follows that the Police should have charged the ‘underage’ defendants in either Kaduna or Kano under the relevant laws of those States instead of dragging them to Abuja. The trial in Abuja was farcical and contrary to   law. It was right and proper that same was discontinued.

Rep Whingan Launches Badagry 1000 Tech Talents Project

Hon. Sesi Oluwaseun Whingan,a member of the House of Representatives for Badagry Federal Constituency, has commenced the training for the first cohort of his landmark “Badagry 1000 Tech Talents Project” (Badagry 1000TTP), an initiative designed to equip 1,000 young people in Badagry with vital digital skills.

 

 

 

 

Premium News reports that recently 200 young participants gathered at KemmySam School in Aradagun, Olorunda LCDA, to begin a four-week intensive training course aimed at transforming them into skilled digital professionals.

 

 

 

 

 

The Badagry 1000TTP, Hon. Whingan’s latest youth development project, seeks to train youths in the areas of Web Development, Product Management, Data Analysis, and Project Management.

 

 

 

 

The initiative is being delivered in partnership with Codeverse Africa, a reputable tech training organization, to ensure the program maintains high-quality standards and practical relevance.

 

 

 

 

Speaking at the opening ceremony, Hon. Whingan, represented by Mrs. Bukola Agemo, a member of the technical committee of Badagry 1000TTP, emphasized the importance of equipping young people with digital skills in today’s economy.

 

 

 

 

“This program represents a crucial investment in the future of Badagry’s youth, empowering them to secure competitive roles in the technology industry. Through this training, we are not only shaping individual futures but also contributing to Badagry’s long-term socioeconomic development,” he said.

 

 

 

 

Participants were drawn from the three councils in Badagry Federal Constituency—Badagry Local Government, Olorunda LCDA, and Badagry West LCDA. Each participant is expected to receive hands-on training that combines theory with practical experience, focusing on real-world applications of digital skills.

 

 

 

 

The training will run intensively over the next four weeks, ensuring that participants receive a solid foundation in their chosen field,a statement said.

 

 

 

As the program progresses, it is expected to empower the youth with the skills needed to pursue careers in technology, thereby increasing their employability and entrepreneurial potential.

 

 

 

The Badagry 1000TTP is an integral part of Hon. Whingan’s broader vision to create a tech-enabled future for Badagry. With this initiative, he hopes to drive digital transformation across the constituency, unlocking new economic opportunities for local youths and positioning Badagry as a rising hub for tech talent in Lagos State.

 

 

Nigeria Attracted 4% Of African Oil,Gas Investments In Eight Years-Verheijen

Nigeria has attracted only 4% of African oil and gas investments since 2016, while investment has surged in other, less resource-rich nations,the Special Adviser to the President on Energy, Olu Verheijen has said.

 

 

 

 

She spoke to a diverse audience, at the African Energy Week in Cape Town, South Africa,a statement signed by her spokesperson, Abiodun Oladunjoye said.

 

 

 

 

She added:“Since 2016, Nigeria has managed to attract only 4 percent of total investments in oil and gas, while less resourced countries in Africa have enjoyed a bigger share. When we analyzed investment data, we also found that, between 2013, when Nigeria’s last deepwater project reached FID, and now, IOCs operating in Nigeria have committed more than $82 billion in deepwater investments in other countries that they have deemed to be more attractive destinations for their capital.”

 

 

 

 

 

Verheijen lamented that the country has  underperformed in oil and gas production despite Nigeria’s wealth in the oil and gas industry.

 

 

 

 

She spoke on how countries like Brazil that has only 30% of Nigeria’s oil reserves has outperformed by producing 131% more than current production of Nigeria.

 

 

 

She said:“Despite our abundant endowments, we have underperformed against our potential. For example, Brazil holds only 30% of Nigeria’s oil reserves but produces 131% more. This is largely due to under-investment”.

 

 

 

She underscored the untapped potential within the industry and highlighted many efforts by President Tinubu’s administration to enact reforms aimed at reshaping Nigeria’s investment landscape.

 

 

 

 

Among these initiatives, she said the government has introduced fiscal incentives targeting deep offshore and non-associated gas projects, marking the first time Nigeria has outlined a fiscal framework specifically for deepwater gas.

 

 

 

She said her office has collaborated closely with the office of the National Security Adviser to create and distribute focused security directives, leveraging insights garnered from on-ground operators.

 

 

 

Besides,Verheijen disclosed  steps to streamline approval processes by clearly defining the regulatory scopes involved.

 

 

 

This initiative, she explained, aims to significantly reduce the extended project timelines that have historically plagued the industry, as well as the high-cost premiums associated with operating in Nigeria.

 

 

 

She added: “Our target is to shorten the contracting timelines from an extensive 38 months to just 135 days, while also working to eliminate the 40% cost premium that currently exists within the Nigerian petroleum industry.”

 

 

 

She also disclosed efforts by the current President Tinubu administration to further open up the oil and gas sector for bigger investments with a set of clear fiscal incentives for non-associated gas and deep offshore oil and gas exploration and production.

 

 

 

She said:“This is the first time that Nigeria is outlining a fiscal framework for deepwater gas since exploration in the basin commenced in 1991″

 

 

 

 

According to her, amongst other initiatives, there has been a focus on midstream and downstream investments in Compressed Natural Gas, (CNG), liquefied petroleum gas, and electric vehicles as part of the Presidential Gas for Growth Initiative.

 

 

 

 

She added that the administration has also worked to streamline regulatory processes, shorten project timelines, and reduce the high-cost premium of operating in Nigeria.

 

 

 

She said:“We have also introduced fiscal incentives to catalyze investments in the midstream and downstream sectors, including, Compressed Natural Gas (CNG), Liquefied Petroleum Gas (LPG), and Mini Liquefied Natural Gas (LNG).

 

 

 

 

“These align with the broader Presidential Gas for Growth Initiative, which seeks to enable the displacement of PMS and Diesel in three key sectors: heavy transport, decentralised power generation and cooking. These incentives are also stimulating demand for Electric Vehicles.

 

 

 

“Our goal is to eliminate the 40% cost premium within the Nigerian petroleum industry and cut down contracting timelines from 38 months to 135 days,” Verheijen stated.

 

 

 

 

She said the government has unlocked over $1 billion across the energy value chain, with two more major investment projects expected by mid-2025.

 

 

 

 

“We are also facilitating the transfer of onshore and shallow water assets to local companies with the capacity to grow production, while supporting the transition of International Oil Companies, with resilient capital, into deep offshore and integrated gas. We have unlocked over $1 billion in investments across the value chain and by the middle of 2025 we expect to see FID on two more projects, including a multibillion-dollar deepwater exploration project, which will be the first of its kind in Nigeria in over a decade – one of many to come.”

 

 

 

She also addressed efforts by the Tinubu administration to revamp the nation’s power sector, with plans to provide more reliable electricity access for the 86 million Nigerians currently underserved.

 

 

 

She said the scheme aims to improve revenue assurance and collection.

 

 

 

 

Other key measures include tackling legacy debt, deploying seven million smart meters to reduce losses, and expanding off-grid solutions for remote communities.

 

 

NLNG Wins FIRS’ Most Compliant Taxpayer Award

NLNG has received the prestigious award of Most Compliant Taxpayer by the Federal Inland Revenue Service (FIRS) at the 2024 FIRS Day, which took place during the Lagos International Trade Fair.

 

 

 

This recognition is part of the FIRS Compliant Taxpayer Award and Recognition Programme, designed to acknowledge companies that consistently meet their tax obligations, contributing to the development of Nigeria’s economy.

 

 

 

This award marks a significant achievement for NLNG, following the Company’s receipt of the FIRS Most Supportive Taxpayer Award in 2021.

 

 

 

The 2021 recognition was conveyed by FIRS, commending the top-performing taxpayers for their compliance, which helped the service surpass its tax collection target.

Assaulters Of Oil,Gas Workers Must Face Music-PENGASSAN

The Petroleum and Natural Gas Senior Staff Association of Nigeria (PENGASSAN),says military and other security agencies allegedly hired by Dutchford E&P, Selective Marine Services and its Labour Contractors to assault oil and gas workers at the Oritsetimeyin Oil and Gas Rig must face the music.

 

 

Specifically,the union said the perpetrators must be held accountable for their actions under both national and international law.

 

 

 

Its President,Comrade Festus Osifo, and the General Secretary,Comrade Lumumba Okugbama,conveyed this in a press statement,wherein they also demanded a full and transparent investigation into this incident, leading to the immediate arrest and prosecution of those responsible for ordering and carrying out the brutal assault on the workers.

 

 

 

Besides,PENGASAN sought a guarantee of the safety and security of all oil and gas workers on the rigs, and a commitment from the relevant authorities to uphold the rights of workers and engage in peaceful conflict resolution.

 

 

 

The statement added:”PENGASSAN will not sit idly while such egregious human rights violations occur. We will utilise all available avenues to ensure justice for the members and to prevent any future reoccurrence.

 

 

 

“We call on all concerned citizens, human rights organisations, and international bodies to join us in condemning this violence and demanding accountability, as silence in the face of such brutality is complicity”.

 

 

 

 

Condemning the act,the union said it negates the tenets of the Nigerian constitution and all extant laws governing the operations in the nation’s oil and gas sector.

 

 

The union warns that if the reports indicate that oil and gas workers are violently ejected from the rig any date soon, PENGASSAN will deploy every means to frustrate such moves; as the  act represents a grave violation of human rights and known labour conventions.

 

 

 

It added:”The use of military actions against unarmed workers is completely unjustifiable and disproportionate because, it is the Nigerian workers who have been subjugated to unfair workplace policies, including being paid meager wages while working in a hazardous environment that should be the complainant.

 

 

 

“While we understand and commend the workers for their professional disposition to keep the oil rigs flowing, the response of deploying the military to violently remove them is unacceptable and demonstrates a complete disregard for human life and the rule of law.

 

 

 

“The use of such force against unarmed civilians engaged in legitimate work is abhorrent and cannot be tolerated”.

 

 

 

 

Govt Alone Can’t Shelter Nigerians-Ooni

The Ooni of Ife,Oba Adeyeye Enitan Ogunwusi,has said that the government alone could not provide adequate housing for Nigerians.

 

 

 

He disclosed this on Friday while receiving former Head of State, General Abdulsalami Abubakar(retd), Bishop Matthew Kukah, General Martin Luther Agwai(retd) at his Ojaja Park, Alagbaka, Akure, Ondo State capital.

 

 

 

 

He implored the private sector to save the sector by making use of local content in terms of materials and human resources.

 

 

 

He disclosed that he embarked on the housing project to reduce the deficit in the sector.

 

 

 

He used locally made materials in the project which he noted,reduced capital flight usually experienced when importing such materials.

 

 

 

He took his visitors round the facilities in the over one hundred thousand square meter estate,and showcased the artworks and other interior decorations done by some young folks who he said are products of Nigerian higher institutions of learning

 

 

 

Oba Ogunwusi said: “We won’t continue to cry over spilled milk. We know that we have a housing deficit in the country, but we need to make do with what we have to get results. We need to buy Nigeria, we need to produce in Nigeria, including our housing needs.

 

 

 

 

“Our project here is a city on its own. It is 100,000 square meters, and we are trying to showcase what is possible in Nigeria. Practically, everything you see here, we know where it came from in Nigeria.

 

 

 

“So, our own mantra is at least 90 percent of things that are made in Nigeria will be used, because a lot of people probably think we do things that are of inferior quality.

 

 

“Today is the official showcasing of Ojaja City to the world. And the official showcasing is to actually let everybody that matters in this country know that whenever there is a will, there is a way.

 

 

 

 

“A lot of good things can happen in our country and if we believe in ourselves, like this typical project, if we believe that Nigeria and Nigerians can do it, then our deficit of housing will continue to reduce gradually.

 

 

 

“Here is an integrated city that you don’t even need to go out. We have everything here, we have a five-star hotel here, game centre, children’s park, we have a shopping mall here, we have park, we have school, we have residential estates.

 

 

 

“So for us, it’s just to model something that has never been done in Nigeria. A lot of people are always very skeptical of our products, that homemade goods, Nigerian made products aren’t good, but we are not skeptical. We went all the way.

 

 

 

 

“We don’t need to leave government to do everything and this is the why I invited General Abdusalam Abubakar and Bishop Mathew Kukah to come and bless this place, because they believe in peace, and they believe in youth engagement, because for us here, it’s all about youth engagement and I believe Nigeria will be a better place.

 

 

 

 

 

“When you are driven by money, you can’t do such a project, it’s not possible, but for me, on the throne, I just want to see a lot of youths and their lives being turned around. And I’m happy, I’m fulfilled. I have thousands of youths that, from nothing, they are something today. So, that’s my objective.

 

 

 

“The numbers, you can’t even count, they are into billions. But, we don’t want to talk about  number here. It’s about passion. What can we do for our dear country? We always blame  government but what are we all doing individually?”

 

 

 

 

 

 

Kano:Gov.Yusuf Hints Of Cabinet Change,Proposes N549bn Appropriation Bill

Kano State Governor,Alhaji Abba Kabir Yusuf,Friday said he will soon drop members of his cabinet rated below performance of statutory schedules.

 

 

 

He said this  when he confirmed the receipt of the report of the committee on the performance of members of the cabinet.

 

 

 

He explained that the report would not be useful now because his close relationship with them in the last one and half years allowed him to know their capability in and out, therefore he would handsomely take the final decision on them.

 

 

 

According to him,none of the present commissioners lobbied for the position, stressing that before their appointment, he considered experience, credibility and advice consultation.

 

 

 

 

He added:”I expected from the commissioners is obedience to my humble self, to the NNPP and to the Kwankeasiyya Movement, in addition to dedication to duty and to come up with good initiatives for the development of the state”.

 

 

 

He spoke on poverty alleviation,saying the  people of the state benefited with free foodstuffs distribution in the urban and rural areas to cushion the hardship being experienced as a result of removal of petroleum subsidy.

 

 

 

 

He assured that the gesture would be sustained to enable thousands of less privilege citizens meet their daily bread.

 

 

 

 

The governor further said KASCO company that provides fertiliser for teeming farmers is under upgrading with a view of providing enough commodities for farmers in order to boost food production.

 

 

 

 

He disclosed that every month 52,000 women and youths across the state receive N50,000 to set up a business and become self-reliance.

 

 

 

Meanwhile,the governor has proposed N549, 160,417,663.00 appropriation bill for the 2025 fiscal year before the Kano state House of Assembly. 

 

 

 

 

The proposed bill tagged,Budget of “Hope, Human Capital and Economic Development,” projected 57 per cent capital expenditure and 43 per cent recurrent expenditure. 

 

 

 

 

The over N549 billion budget proposal for 2025 phiscal year is higher by N111. 8 billion compared with approved budget of 2024.

 

 

 

Presenting the proposed appropriation at the floor of the state House of assembly, Governor Yusuf disclosed that 2025 placed priority on education, health, and infrastructure development in the coming year.

 

 

 

According to him,education takes lion share of 31 per cent (N168.5 bn), Government Institutes 17 per cent (N98.2 bn),health 16 per cent (N90 bn) and Infrastructural development 12 per cent (N70.6 bn).

 

 

 

Other sectoral allocations include :security and emergency services 4 per cent (N23 bn),agriculture 3.8 per cent (N21 bn),environment and sanitation 2.8 per cent (N15.5 bn) and transportation 2 per cent (N12.8 bn).

 

 

 

He pledged that the proposed budget, when passed intended to realize collective dreams and aspirations of the state. He pledged full and proper implementation of the Budget’s provisions to attain high economic prosperity and reduce dependency on grants.

 

 

 

 

He stated that the priority given to education in both 2024 and 2025 fiscal years under the present administration was in fulfilment of campaign promises.

 

 

 

 

Responding,the Speaker of the Assembly, Rt. Hon. Jibril Ismail Falgore assured speedy passage of the budget while calling Ministries,Agencies and Parastatals to prepare for defense of their appropriation.
