EFCC Stalling Progress On $6bn Mambilla Power Project,Says Minister

The Minister of Power, Abubakar Aliyu,says ongoing probe and litigation by the Economic and Financial Crimes Commission (EFCC) is Hampering work on the Mambilla Power Project.

The EFCC had commenced investigation into the $6 billion Mambilla Power Project following controversies surrounding the completion of the project.

Aliyu,who spoke on Tuesday when he appeared before the Senate Committee on Power to defend the 2023 budget,said his Ministry has met with stakeholders and all issues of concern are currently being resolved adding that the issue of litigation on the Mambilla power project is hampering the project .

He added:”Regarding Mambilla, we have met with stakeholders and we are resolving the situation. It has something to do with litigation, there is nothing going on as regards moving to site by the contractor.

“EFCC has stepped into the matter and we have given them information about it, we have given them the history of the Power Project, our lawyers had interfaced with the anti-graft agency, and unless we are able to pull out of litigation, we can’t do anything.I don’t think the investor will bring their money where there is encumbrance.” the minister said.

The Chairman Senate Committee on Power, Senator Gabriel Suswan had earlier raised concern over the situation of the Mambilla Power Project.

He said that the project is a mirage as far as the National Assembly is concerned, adding that money has been budgeted year in year out and there is nothing on ground to show for it.

He added: “To us in the National Assembly, the Mambilla Power Project is mirage , there is nothing to show for it despite the money that has been provided year in , year out.It is clear that the Mambilla power project will not be able to start before the end of this administration.” he said.

The federal government had awarded a $6 billion- Build, Operate and Transfer (BOT), contract to Sunrise Power and Transmission Co. Limited and its Chinese consortium partners on May 22, 2003.

Sunrise consortium had secured $5.5 billion in Chinese Eximbank loans in 2005, while the Nigerian government, on May 28, 2007, signed a $1.46 billion civil works contract with the Chinese firm, Messrs China Gezhouba Group Corporation/China Geo-Engineering Corporation (CGGC/ CGC), in clear violation of Sunrise’s BOT contract.

In November 2007, Sunrise filed a petition to then President Umaru Musa Yar’Adua and the $1.46 billion EPC contract was terminated in 2009.

Accordingly, the Nigerian government signed a General Project Execution Agreement (GOEA) with Sunrise and its Chinese consortium partners for the execution of the Mambilla hydropower project.

On November 12, 2017, the government signed a $5.8 billion EPC contract with another Chinese Consortium, despite numerous written warnings from the current Attorney-General of the Federation to the Federal Ministry of Power, Works and Housing in 2016 and 2017 to respect the GPEA contract with Sunrise. Sunrise resorted to arbitration against the Nigerian State and Sinohydro consortium of China in 2018, claiming $2.3 billion in damages.

Following the intervention of the Chinese president, who sent a special envoy to President Muhammadu Buhari in July 2019, Federal Government and Sunrise signed a settlement agreement in January 2020 and this settlement was advised to both the Chinese Ambassador to Nigeria and Chairman of China Eximbank, who had made the settlement condition precedent to any loans for the project.

But the Federal Government defaulted. Sunrise, in September 2021, withdrew the $500 million settlement arbitration on the condition that the Federal Government makes a financial commitment towards the project and respects its right as the exclusive local content partner, but the Federal Government failed again to make any payments to the EPC contractors and/or the counterpart funds to China Eximbank.

While the Federal Government has been unable to defend its failure to honour its agreements to Sunrise, however, the government requested that the ICC should direct “that Sunrise produce certain information showing its true legal and beneficial ownership.”

Foreign Terrorists Have Infiltrated Yorubaland -Akintoye

The leader of Ilana Omo Oodua, a group championing self-determination for Yoruba people, Professor Banji Akintoye has alleged that some foreign terrorists have infiltrated some parts of South West of Nigeria.

Akintoye, a professor of History,who disclosed this on Tuesday,while addressing the Congress Organised by Ilana Omo Oodua Worldwide in Ibadan, the Capital City of Oyo State,said the latest of such incidents was the abduction of travellers along the Lagos/ Ibadan expressway last Friday.

He implored all Yoruba descendants to demand a change in the Nigerian system which he alleged is faulty and also assured that the Yoruba nation would be actualized before the end of December.

He said Nigeria is going nowhere because Nigeria has been hooked to slave masters,adding that the ruling class are hell-bent on thwarting democratic principles to favour their greed, ego and personal interests.

He alleged that Nigeria as a project was designed to fail.

He added:“Let me say this to all, Nigeria is going nowhere, not because we don’t want it to grow or because we lack the intellectual capacity to make it work, but, It cannot work simply because Nigeria has been hooked to slave masters, the ruling class who are hell-bent to thwart democratic principles to favour their greed, ego and personal interests.

“Furthermore, Nigeria is a project (a country) that is designed to fail; a consumer nation in every ramification and a nation that failed in her responsibility to the citizenry. Nigeria is a nation that lacks technology that could cater for its industry and build a sustainable economy. It is, indeed, a nation of ideological bankruptcy. With these indices, can someone explain how it would work?

“All entreaties for the restructuring and the repositioning of the country had been turned down by the few cabals who hijacked Nigeria and turned it to their personal estate for personal benefits.”

In his remarks, Chief Kunle Adelakun (Eruobodo), Interim General Secretary, Ilana Omo Oodua and Jagunmolu Agbekoya of Yoruba land, said that the President Buhari-led government should be aware that the will of God shall be done because the time to achieve the dream of Yoruba nation is now.

LIRS Boss Ties Lagos Tax Revolution To Tinubu, Sanwo-Olu

The chairman of the Lagos State Internal Revenue Service, LIRS, Mr Ayodele Subair has attributed the success of the unprecedented tax revolution being witnessed in the state, where about 70 per cent of its income is internally generated, to the visionary leadership of the former State Governor and the All Progressive Congress, APC, Presidential candidate, Asiwaju Bola Ahmed Tinubu and the incumbent Governor, Mr. Babajide Sanwoolu.

He disclosed at his LIRS office in Alausa, when the management of the Daily Telegraph Publishing Company Limited, publishers of New Telegraph Newspapers led by the Managing Director, Ayodele Aminu and the Daily Editor, Juliet Bumah paid him a courtesy visit to brief him about the decision to honour him with an award of leadership excellence at a ceremony to be held later in the year.

Thanking the New Telegraph newspapers for finding him worthy of being honoured as a result of the huge successes being recorded by the agency, the LIRS boss added:“Testament to our former governor, Asiwaju Ahmed Tinubu who had that vision to create some independent agencies like the LIRS and making the state to be less reliance on the federal government’s allocation. He is the father of this tax revolution in Lagos State. So we always must give him that credit. Since he made the LIRS board autonomous, the numbers have been leaping in bounds and we hope to continue on that trajectory because we have to provide the funding for the state.The incumbent Governor has been very supportive of our innovations and fresh ideas in tax administration in Lagos State.

It’s all from dedicated leadership and followership. The staff play a very big role in making our numbers rise. Management directs and formulates the policies, and all the various processes that generate such income, but at the same time we need to commend the foot soldiers, they are the ones out in the field who help us to advocate for taxpayers to try and be tax compliant, to respect the social contracts, and to understand that if they want the state to improve in terms of provision of infrastructure and quality services, they need to also make a contribution.”

Subair advised Lagos residents not to relent in their duties by paying their taxes regularly and diligently as it would help the government provide infrastructure and social amenities as attainable in developed countries.

“Everybody goes to the UK, U.S and they are all marvelled at the level of their infrastructure, good road network, free education, electricity and all other things. All these are made possible because the people are highly tax-compliant in that clime. Nobody is chasing anyone about paying taxes. If you don’t pay tax, the sanctions are there. People go to jail.

“There are no two ways about it. But unfortunately in Africa, extended to Nigeria and in Lagos, people don’t want to really pay tax.Yes, globally, people don’t want to pay, if they could avoid it, they would avoid it, So it makes our job very difficult and trickier”

He said while tax is the most sustainable revenue, it took the federal government so long to also start looking inward as tax is basically what is funding the operations of the federal government right now.

“The federal government is not getting much from the oil industry like before. So it is just what FIRS is doing that is really helping. Likewise in Lagos, all the federal receipts have gone down considerably, so it’s mostly what we are generating here along with some other revenue-generating agencies,” he said.

Court Jails 13 Internet Fraudsters In Ibadan

The Ibadan Zonal Command of the Economic and Financial Crimes Commission, EFCC,has secured convictions of thirteen cybercriminals before Justices Olusola Adetujoye and Bayo Taiwo of the Oyo State High Court, Ibadan.

Twelve of the convicts were prosecuted before Justice Adetujoye on separate one count charge each, and one before Justice Taiwo.

The convicts are:Azeez Usman Olatunji, Tofunmi Segun Oyebade, Yusuf Akorede Toheeb Abiodun, Elegbede Abiodun Timileyin, Odewumi Toheeb Olamilekan, Abiodun Adam Kolawole, Uthman Olajire Olamilekan, Ridwan Oladimeji Oluwatobi, Showemimo Akeem Abiodun, Saliu Ibrahim Akanji, Owie Aisosa Kelvin, Ugwu Simon Ogbonna and Olaoye James.

They all pleaded guilty to the charges filed against them by the anti-graft agency.

Prosecution counsel, Oyelakin Oyediran, Sanusi Galadanchi, Samsudeen Bashir and Mabas Mabur reviewed the facts of the cases and urged the courts to convict and sentence the defendants accordingly.

Justice Taiwo convicted and sentenced Olatunji to six months community service while Justice Adetujoye convicted and sentenced Oyebade, Yusuf Akorede, Elegbede, Kolawole, Uthman and Owie to two months community service each.

Besides,Justice Adetujoye sentenced Ridwan, Akanji and Ogbonna to three months community service each, while Odewumi and Showemimo were sentenced to one month community service each.

The courts ordered that the convicts restitute their various victims and forfeit all items recovered from them to the Federal Government of Nigeria.

Reps Demand Probe Of Security Alert

The House of Representatives has implored Nigerian Army to investigate the security alert by some foreign embassies.

Chairman of the House committee on Army, Hon. Abdulrazak Namdas made the call at a budget defence session with the Chief of Army Staff.

He said:“As we sit here and deliberate on this budget proposals, Abuja is under serious tension following a security alert issued in certain quarters suggesting that terrorists may launch a major attack on the city. Recall that in response to this alert, some foreign embassies had ordered the evacuation of their nationals from Abuja. This is a matter that our security forces must thoroughly investigate. The Army must put enough boots on the ground to contain any security breaches in Abuja in the magnitude claimed by the aforementioned security alert.In doing so, the welfare of personnel should be given topmost priority and never be compromised”.

He noted that in recent years, the legislature has worked to improve and sustain the budgetary provision of the Army from N463 billion naira in 2020 to N509 billion naira in 2021 and N589 billion in 2022, adding that the 2023 budget proposal of the Nigerian Army, now under consideration is about 600 billion, urging for judicious application of the provision.

“As aptly captured by Mr President when he presented the estimates of N20.5trillion to a joint session of the Senate and the House of Representatives last month, it is a ‘Budget of Fiscal Consolidation and Transition.’ It targets to cap the achievements of the administration so far in the provision of critical infrastructure, fighting insecurity/insurgency, improving on the economy, providing social welfare to the most vulnerable population and addressing the increasing threats posed to sustainable development by sleaze”.

He said for the Nigerian Army, “It means consolidating the gains recorded in tackling insecurity in its various shades and the attendant challenges. It’s a call not to slide; it’s a call not to sleep and it’s a call to re- strategies and ultimately, conquer the enemy.”

The chairman commended the vision of the current COAS, which is to have “A professional Nigerian Army to accomplish assigned missions within a joint environment in defense of Nigeria”, adding that “the vision centres around working in full collaboration with heads of other sister security agencies, no doubt contributed immensely to the recent successes recorded by our security forces in the counter-insurgency/terrorism operations, fighting banditry, kidnapping and other criminal acts that threaten our collective existence as a nation.

“While I commend the COAS for his efforts, we are not unaware of the sacrifices made by our gallant personnel in the frontline, including loss of lives and the denial of the essentials that make living worthwhile, all so that Nigeria may be safe for all us”, he stated.

In his remarks, the Chief of Army Staff, Lt. Gen. Faruk Yahaya urged the National Assembly to pass the Armed forces of Nigeria Trust Fund Bill before the end of the 9th Assembly.

The passage of the Bill, according to him would greatly assist the Nigerian Army through improved funding.

General Yahaya also called for a review of the current envelope system, which he said leads to inadequate funding for the Nigerian Army due to the increased manpower needs as a result of the expansion of the theater of operations of the Army.

“The Nigerian Army is implementing the Nigerian Army Order of Battle 2026 in phases. This has led to the expansion of the Nigerian army from a five to an eight-division force structure. Consequently, the Nigerian army battlefield in the center and other operational commands were established to effectively provide security for our citizens. He said.

”I must state without mincing words that the expansion of the Nigerian Army has continued to impact significantly on the human resources and lean finances available to the Nigerian Army.” Gen Yahaya noted.

Eko DisCo Boosts Infrastructure With 150 Transformers

Eko Electricity Distribution Company (EKEDC), has taken the delivery of 150 transformers in its bid to improve services to its customers.

Mr. Godwin Idemudia, the General Manager, Corporate Communications, EKEDC,who conveyed this in a statement,said the 150 transformers will be added to the 110 already on ground for distribution to relieve communities whose transformers are currently overloaded.

He stated that this is one of the numerous CAPEX investments the company has made towards improving its services to the customers, assuring that more developments are underway.

He explained that this will improve the distribution company’s services to its customers as it will help in providing a steady and stable power supply across its franchise areas.

According to Idemudia, the transformers distribution and installations will begin soonest across the network as he called on affected areas to please bear with the company as all hands are on deck to reduce overloading on all transformers in the network adding that EKEDC is committed to ensuring 100% customer satisfaction.

He implored customers to support the company in its fight against vandalism and destruction of electrical equipment, citing it as one of the causes of irregular power supply in its network.

He also urged customers to make use of its whistle-blowing platforms to report illegal and unethical activities describing the platforms as safe, confidential, and secure ways of alerting the company of illicit activities.

Africa Requires $40bn Annual Grid Investments To Boost Electricity – Adesina

African countries will require an average of $40bn power grid investments annually for about five years to deliver stable electricity to citizens on the continent, Kola Adesina, Group Managing Director, Sahara Power Group, has said.

Delivering a keynote address on “The Future of Power in Africa” over the weekend at the Lagos Business School, Adesina said projections indicate an increase in energy demand across Africa in the coming years.

He noted that in 2040, this demand could be around 30 per cent higher than what was obtainable currently, adding that it was vital for all stakeholders to work towards shoring up the continent’s power grids through continuous investments.

“Massive investment in Africa’s grids is critical to improve system reliability, expand access and facilitate the integration of variable renewables.Annual investment in electricity grids should more than triple in the 2026‐30 period, compared with 2016‐20, reaching $40bn per year on average. Distribution networks account for over two‐thirds of this total.”

According to him,the projected increase in energy and electricity demand makes access to electricity a quest that Africa must pursue relentlessly.

“In 2021, 43 per cent of the population of Africa, around 600 million people, still lacked access to electricity, 590 million of them were in sub‐Saharan Africa,” he said.

He said,90 million people, or six per cent of the current total population would need to gain access each year on average from 2022 for every African to have access to electricity by 2030

“Africa needs to generate 575 terawatt‐hours more in 2030 than in 2020 to meet the increase in electricity demand projected, an average rate of growth of five per cent per year,” he added.

Power experts say most electricity on the continent are currently produced by thermal plants – gas in many coastal areas, including North Africa; coal in South Africa in particular; and older, generally smaller oil fuel plants almost everywhere.

There are also industry projections that the use of drones and digitalisation, including geographic information systems, outage management systems and smart metering is expected to increase among African power players.

Adesina advocated the need for market reforms and outlined the priority areas for action to include tariff structure reform, and use of concession agreements granting rights to private operators. Others include regulatory carve‐outs for private sector investment and ownership and the introduction of auctions and competitive tenders.

“Reforms to make electricity tariffs cost reflective has been implemented or is under discussion in 24 African countries,” he added.
