SENATE'S REJECTION OF LAURETTA ONOCHIE: A REFRESHING ACT OF PATRIOTISM -  Mike Ozekhome's Chambers

INTRODUCTION
I think for once, something good has come out of Egypt.At least  just for once. The Senate firmly rejected the nomination of Ms Lauretta Onochie as INEC Commissioner representing Delta state. This happened just before the anti-democracy and anti-people National Assembly (NASS) – INEC electronic transmission transfixion debacle. Interrogating this national disgrace is for another piece. But, something positive did  emerge from the “take a bow” 9th Senate of the NASS last week.
Surprisingly this was from the NASS which I had described in an earlier write up as the worst NASS to have emerged in Nigeria ever since the days of Dr. Nnamdi Azikiwe and Dr Nwafor Orizu during the first Republic. The brightest and most progressive of them all was the Dr. Bukola Saraki and Dr Ike Ekweremmadu-led 8th NASS. It  weaned and nurtured democracy. It stood its ground fearlessly and demonstrated its independence as one of the three arms of Government and a strong building block of our fledgling and stunted democracy.
However I do not agree with the Senate that the real reason for Ms Lauretta Onochie’s, rejection was anchored on the Federal character Principle requirement, because Mrs May Agbamuche-Mbu, A serving INEC Commissioner is from Delta State, just like Onochie. I think that was a mere face-saving device and simulated soft landing strategy for the Senate in refusing to square up to the whole truth of the matter.
65 years old Sexagenarian, Lauretta Onochie, born 19th July, 1955, had fervently and publicly denied being politically partisan during the Senate screening. I could not believe my ears. The whole world knows that she had registered as No. 2 in Ward 4, Aniocha North L.G.A. of Delta State, during the recent APC Nation-wide membership registration exercise. More curious about her incredible and incredulous denial stems from the fact that in an affidavit she personally swore to in the case of LAURETTA ONOCHIE VS EMEKA AGWUONYE (as recent as 30th June, 2021), which is currently  pending before the FCT High Court, Abuja, she had attached her own passport photograph. In that case, Onochie had deposed affirmatively in paragraph 3 inter alia, thus: “I am also a member of the All Progressive Congress and a Volunteer at the Buhari Support Organisation (B.SO)”.
I could therefore not believe my eyes when I beheld her frontally and publicly denying membership of the APC and an ardent supporter of President Buhari.
Onochie’s nomination as INEC Commissioner representing Delta State (and by extension, the South South) had therefore triggered national outrage and ruckus because of her glaring political partisanship. Constitutional, democratic and moral hurdles were thus cited by a cross section of Nigerians, including politicians, Lawyers (I am one of them), the opposition PDP, public officers, analysts and the Civil Society, as afflicting her desperately sought-for appointment. Inspite of this,  Onochie boldly appeared before the Senate for screening.She strangely and imperiously thumped her chest as “Madam Due Process”.
Really? Not so fast, madam! She then lied before a bewildered Nation, “since Buhari was elected as president for the second term, I have removed myself from everything about politics. Since 2019, I do not have anything to do with politics. As I am sitting here, I am not a member of any political party in this country”. I wept for Nigeria and for decent womanhood beholding a desperate old woman lying between her teeth, just to get a mere INEC appointment. At 65! This is the age most Civil Servants retire to their homes. What is in this INEC seat to force a woman to throw away her dignity and self respect? Onochie LIED.
For starters, her recent registration as No 2 in Ward 4, Aniocha North LGA of Delta State, during the recent registration exercise shows the falsity of her declaration. Secondly, an affidavit she personally deposed to in a case in which she is the plaintiff as lately as 30th June, 2021, also clearly affirmed that she is still a member of the APC and a volunteer at the Buhari Support Organisation (BSO). Wait for the icing on the case: on June 24, 2020 ( well after she claimed to have quitted partisan politics in 2019 ) , she had made an outing by tweet on the social media, promoting the APC, and stating that the party was merely going through the pangs of a growth process. This was during the leadership crisis that engulfed the APC, threatening to consume this  party of disparate tendencies. In my humble opinion, this brazen denial of her membership of the APC during her screening demonstrated, more than anything else, her total lack of integrity and moral high grounds in being entrusted with such a sensitive job that borders on midwifing the will of the people. It was impunity taken too far.
Let me be very clear about this. There is nothing wrong about Onochie belonging to the APC, or to any other political party of her choice. There is also nothing wrong with Onochie rolling out the drums to support President Buhari, whether before, during, or after the 2015 and 2019 presidential elections. These are her inalienable constitutional rights. But, she cannot enjoy these rights simultaneously with being an INEC Commissioner. She cannot be a bat who argues that she belongs to the Animal Kingdom, because she possesses mammary glands (breasts), pinnas (ears), and teeth, like those of human beings; but that she is, at the same time, a member of the Birds Kingdom, because she can fly very well. As the name suggests, the Independent National Electoral Commission” is expected to be truly independent. The word “independent” means “liberated”, “unrestrained”, “unconstrained”, “bold”, “individualistic”.
Can 65 year old Onochie, a die-in-the-wool APC fanatic, pick up the Holy Bible (as a Christian) and swear that if she had been cleared by the Senate as INEC Commissioner, she would have been truly unrestrained, unconstrained, bold, individualist, and liberated from the apron strings of Buhari and the APC? I think not, or, do you? Could Onochie have been so independent and liberated from her benefactor ,Buhari, and her political party, in such a way and manner as to take firm decisions in an election against their interest? I think not. Or, do you?
Indeed, Part 1 paragraph F to the third schedule of the 1999 Constitution provides that Resident Electoral Commissioners shall be persons of “unquestionable integrity”. Can Onochie, a member of a political party who is crazily and passionately partisan to her party and her benevolent appointor, the President, be a person of “unquestionable integrity”? I believe not. Or do you? Her mere admission of once belonging to the APC and supporting Buhari, but that she had recanted and renounced them ( even if believable), are the very reasons why she should never come near the corridors of ballot papers and boxes.
The truth of the matter, and I can categorically conjecture why Onochie was rejected, is that she has been one of the most fantatical and consumate supporters; and a vociferous card-bearing member of the APC. She is not just an APC card-carrying member; she has always been the Personal Assistant to President Muhammadu Buhari on Social Media Affairs. She loves wearing a long ankle- length t-shirt emblazoned with a larger-than-life portrait of Buhari. She deifies him; canonises him.No problem about this; it is her right.But, please, Onochie, stay far away, far far away, from the hallowed precincts of INEC. Keep Off please !!!
Onochie has always used the social media outlet to attack every and all Nigerians that dare to disagree with her mentor and deity, Buhari. She  abuses them all. Freely. She deploys  obscene expletives, caustic language, utmost vulgarity and asinine inanities.
Waziri Atiku Abubakar was not spared by Onochie’s putrid vituperations.She accused him of shopping for terrorists in Dubai and being a wanted man. Atiku is in court against Onochie over this. I am his lawyer. Onochie had also attacked me in the social media some years ago, for daring to criticize Buhari, her god. I refused to dignify her with a response, so as not to belittle my humble self. But, she was not so lucky with roaring and cerebral Chief Femi Fani Kayode ( FFK),  whom she dared attack. She had touched the tiger by the tail. FFK would not accept that, not let go. He took her to the cleaners and literally tore her to shreds. With bare knuckles; intellectual superiority. I had guffawed.
Therefore, such a palpably partisan person was not fit for, or confirmable for the sacred position of INEC Commissioner. She would have been the biggest liability to this already baggaged Government. She would have further polluted the electoral process, since she is a known unabashed presidential aid and a card-carrying member of the APC , who can never go against her boss or political party in any matter involving elections. She was brutally partisan. She did so without any remorse, sense of guilt or shame whatsoever. Her rejection was therefore good riddance to bad rubbish.
Whether for reason of federal character (section 14 of the Constitution), or for the reason of her well known unabashed partisanship, the important thing is that Onochie was roundly rejected. Like some people would say jocularly , whether it was Jonah that swallowed the fish, or it was the fish that swallowed Jonah, the important thing is that there was a “swallow”.
 My kobo piece piece of advice to Lauretta. Madam, quietly stay put in your propaganda corner with your job as Buhari’s social media attack dog. In this, I believe you have done pretty good. I score you well above average. But, for INEC job, farewell! Goodbye!! Adieu!!!
I therefore salute the Senate of the 9th NASS for developing balls for the first time; at least on this singular occasion. Kudos to the Ahmed-Lawan led Senate on Onochie’s rejection as INEC Commissioner.

External Loans:Senate’s Option Of Sanction Against AGF Officials Right-CACOL

The Centre for Anti-Corruption and Open Leadership (CACOL) has given its support  to the recommendation  by the Senate for sanction of officials in the Office of the Accountant-General of the Federation, who reportedly made Nigeria to lose $274.2million (N54.1billion) on external loans.
The group conveyed its position in a statement signed by Tola Oresanwo, its Director of Administration and Programmes, on behalf of its Chairman, Debo Adeniran.
It recalled that the Senate approved the report of the Senate Committee on Public Accounts before proceeding on annual vacation last week.
According to the group,the Senate, in its resolution, asked the Accountant-General of the Federation, Ahmed Idris, to identify the officers and sanction them for mismanaging public funds, in accordance with Rule 3115 of the Financial Regulations and for gross misconduct.
It also noted the provision of Rule 3115 of the Financial Regulations, which stated that, “An accounting officer who is queried for his failure to manage or spend public funds, effectively or who spends public money without due regard to economy contrary to Financial Regulation 415 and fails to reply to the query, shall be removed from the schedule and be disciplined in accordance with the Public Service Rules.”
CACOL revealed that the Senate, in its resolution after the presentation of the report of the Senate Committee on Public Accounts by Senator Matthew Urhoghide, upheld the recommendation of the committee asking that officials involved in the transaction be sanctioned.
Adeniran was quoted in the statement as saying that:“The attitude of some public officials while managing public funds are suspect and questionable. It is a known fact that some government officials willy-nilly act in ways that are counterproductive to the economy of the country.Just as has been noted elsewhere, in discharging their responsibilities to the people, any governmental official, serving in any ministry, department or agency of government would do well to adhere to international best practices in discharging their responsibilities to and on behalf of the people.
“It is our unequivocal position that in the process of obtaining a loan for the country, cumbersome additional expenses should not be added to the already excruciating debt burden.To this end, officials of government must pay attention to details at all times and be seen like Caesar’s wife to be above board”

 Olubadan Dispatches  Delegation To Cotonou To Observe Igboho’s Court Proceedings 

The Olubadan of Ibadanland, Oba Saliu Akanmu Adetunji, Aje Ogungunniso 1 has sent a delegation to Cotonou, Benin Republic to observe the proceedings of the court case involving Chief Sunday Adeyemo, also known as Sunday Igboho.
The fmonarch who did not disclose the identity of the delegation said yesterday that those to observe the court proceedings where Sunday Igboho will be facing trial would be in court today.
Oba Adetunji spoke  at his Popoyemoja, Ibadan palace on Sunday while exchanging views with some leaders of thought comprising the Central Council of Ibadan Indigenes President General, Prince Yemisi Adeaga, first vice President General, Dr. Tirimisiyu Oladimeji; Ekefa Olubadan, Senior Chief Lekan Alabi; Ajia Olubadan, Chief Wasiu Aderoju Alaadorin; Mogaji Makusota, Prof. Oluwasegun Adekunle and Personal Assistant to Olubadan, Mr. Adeola Oloko.
He said it has become necessary in order to allay the fears of several people including protesters who besiege Olubadan palace every now and then that Kabiesi is not folding his arms over the travails of Sunday Igboho and his co-travellers.
“Sunday Igboho lives in Ibadan, got married in Ibadan, rear children in Ibadan, built houses in Ibadan and as such he has the rights to be protected by Ibadan Traditional Institution within the ambit of the law just like any human being in Ibadan.
The  monarch,who stated that he was in constant touch with Yoruba prominent royal fathers, including Igboho royal crowns allayed public fears of a repeat performance of Yoruba-Fulani coalition of 1814. According to Oba Adetunji, students of Nigeria history may wish to be reminded that when some people during the period under reference chose to engage in territorial expansion to the sea, it took the Ibadan army under Balogun Oderinlo to repel the attack and stop the incursion near Osogbo.
 ASUU Threatens  Fresh Strike

The Academic Staff Union of Universities says it may resume   industrial action following the continuous refusal of the federal government to honour the agreement it signed with the union.
The ASUU Chairperson of the Abubakar Tafawa Balewa University, Bauchi, Dr Ibrahim Inuwa,gave the indication while speaking with some journalists at the Union’s Secretariat at the weekend
He  said that the strike was suspended in December 2020, after ASUU and the federal government signed a Memorandum of Understanding on the various issues providing timelines for the implementation of each of the eight items.
“It is over seven months after the MoU was signed and the federal government only addressed two out of the eight issues.Enough is enough, ASUU is fed up with deceptive antics of the federal government of Nigeria”
“The university campuses are becoming restive across the length and breadth as academics are threatening to shut down activities once again. This is coming as a result of the failure of the federal government to implement many aspects of memorandum of Action (MoA) it willingly signed with ASUU that ended the last strike in December, 2020”
 “Given the glaring and deliberate failure of Government to honour the agreement it willingly signed with the union, it is becoming obvious that industrial harmony is gradually being destroyed in the university campuses.
“We therefore call on well meaning Nigerians to wake up the Federal Government  from its slumber to avoid another disruption of academic activities on Universities Campuses across the nation, the atmosphere is tenses and charged” he said

Man Accused Of Trying To Assassinate Mali President Dies In Custody

Man accused of trying to kill Mali president dies in custody | Mali News |  Al Jazeera
A man accused of attempting to stab Mali’s interim President Assimi Goita last week has died in hospital while in the custody of security services, the government said in a statement on Sunday.
Goita, a special forces colonel who orchestrated two coups in the last year, escaped unharmed after the assailant tried to stab him during prayers at a mosque in the capital Bamako on Tuesday.
Security agents threw a man into the back of a military pickup truck, video obtained by Reuters showed, as Goita was ringed by bodyguards.
“During the investigations … his state of health deteriorated,” the statement said. He was taken to hospital, where he died, it said.
An investigation is underway to determine the cause of death.
Mali, the theatre of French-supported operations against al Qaeda and Islamic State-linked insurgents for a decade, was thrown into political turmoil after a military junta led by Goita toppled President Ibrahim Boubacar Keita in August 2020.
Goita served as vice-president to transitional leader Bah Ndaw until the latter’s ouster in May.

Don’t Execute Detainees,Group Begs Governors

Avocats Sans Frontières France (Lawyers Without Borders France),has expressed concern over the recent recommendations  offered by the Minister of Interior ,Rauf Aregbesola as a means to decongesting prisons in Nigeria
Aregbesola had last Friday,while  speaking at the inauguration of the Osun State Command headquarters complex of the Nigeria Correctional Service in Osogbo, urged state governors to sign the death warrants of three thousand and eight (3008) detainees in order to decongest correctional facilities nationwide.
The group said:”It is worrisome to learn that out of the total prison population of 68,747 inmates, only 17,755 inmates are the actual convicts with 50,992 inmates representing about 74% are awaiting trial.The statistics as revealed by the Minister clearly shows that the current congestion in Nigerian Prisons is as a result of the disturbingly high number of awaiting trial inmates and not the minority population on death row.
The group said a more constructive approach would be a declaration of a state of emergency in Nigeria’s criminal justice system with programs and initiatives rolled out to tackle the slow pace of justice delivery in Nigeria.
It said this should be done with a view to reducing the awaiting trial population, many of whom have spent 8 years or more awaiting trial.
“The call for execution by the Minister comes at a time when many countries across the globe and particularly in Africa continue to move away from using the death penalty due to its injustices. Just 3 days ago, Sierra Leone became the latest nation to abolish the death penalty after Malawi.Avocats Sans Frontières France uses this opportunity to reiterate that the death penalty is inhumane, obsolete and does serve as a deterrent. It is used disproportionately against the poor. It is a violation of the right to life and execution is irreversible even where fresh evidence surfaces to exonerate the convicted.
“ASF France urges the Nigerian government to declare an official moratorium on execution while it tackles the huge problem created by the awaiting trial population in Nigeria. We remain committed to working with national partners to address the challenge of prison congestion in Nigeria”, the group said in a statement.
69 Nigerians Die Of  COVID-19 in 11 Weeks-NCDC

The Nigeria Centre for Disease Control (NCDC),has said that few infections this month was more than those recorded in May and June combined.
A data from the agency revealed that as of May 31 and June 30, the number of new cases was 1,408 and 1,100 cases, totalling 2,508.
The total number of new COVID-19 cases reported as of July 24 is 3,277,it said,adding that the total number of COVID-19 deaths from May 1 to July 24 is 69.
Besides,the  Nigeria Centre for Disease Control (NCDC) says the country’s COVID-19 active cases now stand at 4,180, with majority of the infected people in stable condition.
In its verified website, the centre said it registered 216 new COVID-19 cases as of July 25,adding that the new infections indicate a decline from the 272 cases recorded a day earlier.
The NCDC said that the country did not record any COVID-19 related death on Sunday and the total fatalities so far stood at 2,132.
It said the country had also tested more than 2.4 million samples for the virus out the country’s roughly 200 million population.
According to the centre, of the 216 new cases, 108 were reported in Lagos and 96 in Akwa Ibom.
The NCDC disclosed that one patient was discharged on Sunday after recovering from the virus.
It stated that out of a total of 171,111 positive infections confirmed in the country, 164,789 patients have been discharged.
