An Oyo State High Court sitting in Ibadan, has stopped the Department of State Services (DSS) and the Attorney General of the Federation, Abubakar Malami (SAN), from arresting, intimidating, harassing and freezing the bank accounts of Yoruba nation agitator, Sunday Adeyemo popularly known as Sunday Igboho.
The restraining order was granted by Justice Ladiran Akintola, following an ex parte motion moved by Igboho’s lawyer, Chief Yomi Alliyu (SAN), at the court on Wednesday.
The motion was sequel to the originating summons seeking N500 billion damages for the invasion of Igboho’s residence in Ibadan, the Oyo State capital, on July 1.
Alliyu expressed confidence that the AGF will not disobey the court order, stressing that it was given directly against his office.
The DSS had July 1st,this year, invaded Sunday Igboho’s house in Ibadan killing two of his associates and arrested 12 that are currently in the custody of the secret police in Abuja.
Besides,a Federal High court sitting in Abuja has granted bail to the twelve ( 12) associates of Yoruba nation activist, Sunday Adeyemo, also known as Sunday Igboho who have detained by Department of State Service ( DSS ) since their arrest on July 1, 2021
Justice Obiora Egwaatu while ruling on the enforcement of fundamental rights suit filed by their lawyer, Pelumi Olajengbesi granted four ( 4) of the agitators bail with the sum of N10million each and two sureties each in like sum who must have a verifiable means of identification.
The remaining eight ( 8 ) were granted bail with the sum of N5million each with two sureties each whom must be a civil servant.
The sureties must also be a resident of Abuja.
At the resumed hearing of the case Pelumi Olajengbesi, Lawyer to the 12 detained associates of Yoruba nation activist, Sunday Adeyemo, also known as Sunday Igboho, prayed the court to admit his clients to bail unconditionally.
Olajengbesi made the plea following the production of the 12 detainees before Justice Obiora Egwuatu on Wednesday.
He argued that to continue to keep the applicants in the custody of the service would amount to an affront on the constitution and infringement on their fundamental human rights as provided by the law.
But, counsel to the DSS, I. Awo opposed the application for bail for four of the applicants in custody saying that the service have not concluded their investigation.
He argued that his objection to the bail application was predicated on the grounds
of the level of their involvement in the offences preferred against them.
He added that investigation so far had revealed high level of complicity on the part of the four detainees.
Meanwhile,Aareonakakanfo of Yorubaland,Iba Gani Adams has applauded Justice Obiora Egwuatu’s ruling granting the 12 aides of Chief Sunday Adeyemo, popularly called Igboho, bail after spending 32 days in Department of State Services (DSS) custody.
Iba Adams, in a statement by his Special Assistant on Media,Mr. Kehinde Aderemi, described the judgment as a reflection of people’s hope in the judiciary.
He expressed hope in the ability of the judiciary, saying the judiciary remains the bastion of hope to the people.
“Let me applaud the courage of Justice Obiora Egwuatu for her strength of character. She has distinguished herself as a, woman of hope and with today’s ruling, I think ordinary people can begin to repose faith in the judiciary”.
He commended the detained aides for standing firm in the face of stiff condition.
