A Federal High Court in Ado-Ekiti has struck out the case of defamation against human rights lawyer,Dele Farotimi, instituted against him by the Inspector General of Police, IGP Kayode Egbetokun.
Prosecuting counsel, Mr. Samson Osobu, told the court on Wednesday that he had filed a notice of discontinuance and withdrawal brought pursuant to section 108(1)(2)(a) of the Administration of Criminal Justice Act 2015.
According to him,the notice is to withdraw the charge against the defendants and pray that the charge be struck out.
He said:”The nominal complainant has expressed his desire to discontinue the case”.
Counsel to the defendant, Mr. A. Olumide Fusika, SAN,raised no objections to the discontinuance and withdrawal of the suit.
He said:”We are not opposed to the discontinuation of the charge”.
In his ruling,Justice Babs Kuewumi,struck out the suit.
